These Website Terms of Use ("Terms") are an agreement between you and Black Thumb Mobile Garage LLC ("Black Thumb," "we," "us," or "our"). They govern your access to and use of blackthumbgarage.com and its forms, content, and related website features (collectively, the "Website").

Please read these Terms carefully. By using the Website or submitting a form, you agree to these Terms. If you do not agree, do not use the Website.

1. Website Purpose

The Website provides general information about Black Thumb's mobile automotive services, private automotive instruction, youth classes, service area, and business. It also allows adults to submit inquiries and request that Black Thumb contact them about possible services.

The Website is not an emergency service, roadside-assistance dispatch service, repair manual, diagnostic tool, or substitute for an in-person vehicle inspection.

2. Eligibility and Youth-Class Inquiries

You must be at least 18 years old and legally capable of entering into an agreement to submit a form or request services through the Website.

Information about youth automotive classes is provided for parents, legal guardians, schools, and approved program partners. A parent, legal guardian, or authorized adult representative must submit all youth-class inquiries. Children under 13 must not submit personal information through the Website.

3. General Automotive Information

Website content is provided for general informational purposes. Vehicles, symptoms, working conditions, and repair needs vary. Nothing on the Website is a diagnosis, repair instruction, safety certification, guarantee of vehicle condition, or recommendation that you drive or continue operating an unsafe vehicle.

Do not rely on Website content to handle an emergency or determine whether a vehicle is safe to operate. If a vehicle may be unsafe, stop using it when it is safe to do so and contact an appropriate towing service, emergency provider, manufacturer, or qualified repair professional.

4. Service and Instruction Requests

Submitting a form:

Requests contact from Black Thumb;
Does not guarantee availability, eligibility, scheduling, pricing, diagnosis, parts availability, or completion time;
Does not create an appointment;
Does not authorize Black Thumb to inspect, disassemble, repair, maintain, move, or operate a vehicle;
Does not create a repair, instruction, or other service contract; and
Does not require Black Thumb to accept the requested work.

An automated confirmation only means that the Website received your submission. It is not an acceptance of the request or a promise that services will be provided.

Black Thumb may decline a request based on vehicle age or condition, requested work, service area, location safety, scheduling, parts or equipment needs, or other practical considerations.

5. Estimates, Authorization, and Separate Service Terms

Any automotive inspection, diagnosis, maintenance, repair, or instruction that Black Thumb agrees to provide will be governed by a separate estimate, work authorization, invoice, waiver, or other service-specific agreement, as applicable.

Before work begins, the parties may need to confirm matters such as:

The requested scope of work;
Labor rates, parts, travel, and other charges;
Payment timing and accepted payment methods;
The service location and working conditions;
Customer authorization to inspect or work on the vehicle;
Changes to the work or price;
Cancellation or rescheduling terms;
Parts selection and availability;
Any workmanship or parts warranty; and
Safety requirements or instructional waivers.

If these Terms conflict with a signed estimate, work authorization, instruction agreement, or other service-specific agreement, the service-specific agreement controls for that service.

No repair or maintenance work is authorized merely because you submitted information through the Website. Additional or changed work will require the authorization required by the applicable service agreement and Oregon law.

6. Your Responsibilities

When using the Website or requesting contact, you agree to:

Provide information that is accurate and complete to the best of your knowledge;
Submit a request only for a vehicle you own or for which you are authorized to request inspection, repair, maintenance, or instruction;
Provide current contact information;
Describe known symptoms, safety concerns, modifications, access limitations, or hazardous conditions that may be relevant;
Avoid submitting Social Security numbers, financial account information, medical information, or other information not reasonably needed for the request; and
Update or correct material information before services begin.

If services are scheduled, you are responsible for providing lawful access to the vehicle and a reasonably safe, suitable work area. Black Thumb may stop, postpone, or decline work if the location, weather, vehicle condition, presence of people or animals, available space, or another circumstance creates a safety concern or prevents the work from being performed appropriately. Any specific site requirements will be addressed before or at the appointment.

7. Automotive Instruction

Private automotive instruction is educational and may be tailored to a participant's vehicle, skill level, and project. Automotive work can involve hazards, including heavy components, lifts and jacks, sharp objects, hot surfaces and fluids, chemicals, electricity, pressurized systems, power tools, and moving parts.

Website content does not qualify anyone to perform automotive work. Participants must follow all instructions and safety requirements, use appropriate protective equipment, and avoid work beyond their ability or available equipment. Black Thumb may require a separate instruction agreement, safety acknowledgment, or liability waiver before a session.

Youth instruction is available only through arrangements involving a parent or legal guardian, school, the DIY Cave, or another approved program partner, as appropriate. Additional permissions and program-specific rules may apply.

8. Acceptable Use

You may use the Website only for lawful, personal, and legitimate business-inquiry purposes. You may not:

Submit false, misleading, fraudulent, or unauthorized requests;
Impersonate another person or misrepresent your authority;
Attempt to bypass reCAPTCHA, security measures, access controls, or rate limits;
Introduce malware, harmful code, automated scraping tools, or disruptive traffic;
Probe, scan, or test the vulnerability of the Website or related systems without written permission;
Interfere with the Website's operation or another person's use of it;
Use Website content to create a competing website or commercial database; or
Use the Website in a way that violates law or another person's rights.

We may restrict or block Website access when we reasonably believe it is necessary to protect the Website, Black Thumb, our providers, customers, or the public.

9. Intellectual Property

The Website and its original text, graphics, photographs, logos, branding, layout, and other content are owned by Black Thumb or used with permission and are protected by applicable intellectual-property laws.

You may view and print reasonable portions of the Website for your personal, noncommercial use. You may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially exploit Website content without prior written permission, except as allowed by law.

Black Thumb respects customers' right to provide honest reviews and feedback. Nothing in these Terms prohibits or penalizes a lawful and honest consumer review. You may not disclose another person's confidential or private information, make knowingly false statements of fact, or include unlawful content.

10. Privacy and Electronic Communications

Our [Privacy Policy] explains how we collect, use, disclose, and retain information obtained through the Website. By submitting a form, you consent to receiving communications reasonably necessary to respond to and manage your request, including by email or telephone using the contact information you provide.

Black Thumb does not use Website forms for text-message marketing or email-newsletter enrollment. Your standard carrier or internet charges may apply to communications you choose to receive or initiate.

11. Third-Party Services and Links

The Website may rely on or link to third-party services, including Wix, Google, Microsoft, maps, or other websites and technology providers. Third-party services are governed by their own terms and privacy practices. Black Thumb does not control and is not responsible for third-party content, availability, security, or practices.

A link does not necessarily mean that Black Thumb endorses or guarantees the third party, its products, or its services.

12. Website Availability and Changes

We try to keep Website information accurate and useful, but we do not guarantee that all content is complete, current, error-free, or available at all times. Service descriptions, availability, service areas, prices, and Website features may change without notice.

We may modify, suspend, or discontinue any part of the Website. We are not responsible for interruptions caused by maintenance, third-party providers, internet failures, security events, or circumstances beyond our reasonable control.

13. Website Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." BLACK THUMB DISCLAIMS IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THIS WEBSITE DISCLAIMER APPLIES TO THE WEBSITE AND GENERAL WEBSITE CONTENT. IT DOES NOT REPLACE OR LIMIT ANY EXPRESS WARRANTY PROVIDED IN A SEPARATE WRITTEN SERVICE AGREEMENT, AND IT DOES NOT WAIVE RIGHTS OR WARRANTIES THAT CANNOT LAWFULLY BE WAIVED.

14. Limitation of Liability for Website Use

To the fullest extent permitted by law, Black Thumb will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from access to or use of, or inability to use, the Website. For claims arising solely from Website use and not from paid automotive or instructional services, Black Thumb's total liability will not exceed $100.

These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, gross negligence, or personal injury to the extent applicable law prohibits limitation. They also do not govern liability arising from paid repair or instruction services, which is addressed by applicable law and any service-specific agreement.

15. Responsibility for Misuse

To the extent permitted by law, you are responsible for losses, claims, or expenses reasonably resulting from your intentional unlawful misuse of the Website, your fraudulent submission, or your infringement of another person's rights. This section does not require a consumer to indemnify Black Thumb for Black Thumb's own negligence, unlawful conduct, or breach of these Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any lawsuit concerning these Terms or Website use must be brought in a state or federal court with jurisdiction in Deschutes County, Oregon, unless applicable consumer law permits or requires a different location.

Before filing a lawsuit, the parties are encouraged, but not required, to attempt to resolve the concern informally by contacting one another. Nothing in these Terms prevents either party from using small-claims court when eligible or seeking urgent injunctive relief.

17. Consumer Rights

Nothing in these Terms limits rights or remedies that cannot be waived under applicable federal, state, or local consumer-protection law. If a provision conflicts with a nonwaivable legal right, the law controls and the remaining provisions continue to apply.

18. Changes to These Terms

We may update these Terms when the Website, our practices, or legal requirements change. The revised Terms will be posted on this page with an updated "Last updated" date. Changes apply prospectively when posted unless a later date is stated. Your continued use of the Website after the effective date of revised Terms constitutes acceptance of the revised Terms.

Material changes to a separate repair, instruction, or other service agreement require the form of agreement or authorization applicable to that service. Updating these Website Terms does not alter a previously signed service agreement.

19. Severability, Waiver, and Assignment

If a court finds part of these Terms unenforceable, that part will be enforced to the maximum extent permitted or severed, and the remainder will remain effective.

A failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent. Black Thumb may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the Website or business.

20. Entire Agreement

These Terms and the Privacy Policy are the entire agreement concerning use of the Website. They do not replace any estimate, work authorization, waiver, invoice, warranty, or other agreement governing actual automotive or instructional services.
